Do we always handle them correctly? Can we do it better? During this session, we will examine some real life, outrageous workplace situations and discuss the potential issues posed by each situation and best practices for addressing them.

NATHAN SCHNETZLER-FRITH, ANDERSON, PEAKE PC

Why You Need A Rapid, Effective Response to Harassment in the Workplace

All the training in the world cannot prevent a bad actor from creating a hostile work environment in the workplace. The key to minimizing exposure from these circumstances is creating an effective and responsive reporting structure and confirming that individuals serving in positions that are likely to receive reports of harassment understand what can potentially constitute harassment and the importance of (1) quickly alerting relevant team members of the complaint; (2) providing a supportive, non-retaliatory environment for the complaining employee; and (3) confirming that responsive measures are actually effective.

A discussion of actual cases where theoretically sound reporting structures failed and resulted in either findings of responsibility at the EEOC and/or resulted in litigation. The presenter will discuss lessons learned from these cases.

Finally, an open discussion of the pros and cons of various types of reporting structures. Can the multiple-channel complaint reporting structure cause more harm than good? Should we cut out the middle man and require all reports go to HR? Should the company invest in a third-party anonymous reporting information?

MICHAEL R.
